Intellectual Property
OriginClear’s Intellectual Property (“IP”) portfolio has been in continuous development since 2008. Early patents focused on algae harvesting. Beginning in 2015, the company applied this knowledge to water treatment and began development of EWS.
In 2018, OriginClear reorganized its intellectual property portfolio to focus exclusively on its electrochemical water treatment solution, Electro Water Separation™ (EWS) with Advanced Oxidation (AOx™).
On May 25, 2019, in its Annual Report for the fiscal year ended December 31, 2018, the Company stated, “we have chosen to protect certain intellectual property with trade secrets rather than patents”. In the intervening year, the Company has extended this policy to its entire portfolio, having concluded that sharing inventions at this time through the patent process equates, over time, to giving up that technology.
Accordingly, OriginClear no longer actively maintains its patent applications and patents, willingly deeding them to the water industry as an open resource. The Company intends to reserve to itself and its partners the protected communication of further discoveries and trade secrets relative to the EWS and AOx technology domains.
The company continues to further improve and expand its technology’s scope, efficiency and reliability.
Registered Trademarks:
On April 2, 2015, we filed a trademark application with the USPTO to protect the intellectual property rights for our wordmark “OriginClear”. On August 16, 2016 the wordmark was registered with Registration Number 5023444. The registration is current.
On April 8, 2015, we filed a trademark application with the USPTO to protect the intellectual property rights for our current company logo “OriginClear” with the stylized “O”. On August 16, 2016 the mark was registered with Registration Number 5027992. The registration is current.
Patents we have licensed:
On June 25, 2018, Daniel Early granted us a worldwide, exclusive non-transferable license to intellectual property consisting of five issued US patents, and design software, Computer Aided Design, marketing, design and specification documents (the “Early IP”).
On May 20, 2020, we agreed on a renewal of the license for an additional 10 years, with three-year extensions. We also gained the right to sublicense, and, with approval, to create ISO-compliant manufacturing joint ventures. All royalties surviving the 2018 license were settled.
We may contract with distribution channels (equipment distributors, oil service companies, water treatment companies, system integrators and engineering companies) of our choice to act on our behalf for the purpose of selling and integrating the Early IP.
The Early IP consists of combined protection on the materials and configurations of complete packaged water treatment systems, built into containers.

Licensing
We generally distribute our technology through licensing and joint ventures. To help you test your markets before committing to full-scale manufacturing, we supply proof-of-concept units and prototypes as well as limited-volume production runs. These systems will then be a reference for your own manufacturing. Our licenses are non-exclusive, but regional preferential treatment is negotiable (“Most Favored Nation”).
